Acceptable Use Policy

1. Introduction
FandomHost, LLC’s Terms of Service include this Acceptable Use Policy (“AUP”) by reference, which also regulates your use of the Services. The definitions of words used in this AUP are as given in the words of Service, unless otherwise indicated. This AUP may be changed by FandomHost, LLC at any moment and without prior notice.
FandomHost, LLC’s services may only be utilized for legitimate reasons. You pledge to abide by all laws, rules, and ordinances that may be relevant to your use of the Services. FandomHost, LLC maintains the right to deny service to any individual. Anything that, in our opinion, in any way breaches this AUP may, with or without prior notice, be taken down from our servers (or disabled in some other way). Should you neglect to reply to an email from our abuse department within the timeframe provided in our correspondence with you, the Services may be suspended or terminated.
Agents, representatives, and end users (collectively, “Users”) are under your control, and it is your responsibility that they follow this AUP. It is your responsibility to use the Services only for lawful business and commercial purposes. You may not use the Services for any illegal, offensive, abusive, or disruptive activities that could negatively impact the Services or how users use them (such as intentional overloading of systems and broadcast attacks), or that could put FandomHost, LLC in legal hot water.
2. Restricted Applications
Rights to Intellectual Property Violated
It is not permitted to use the Services in order to violate the intellectual property rights of another party. This include, but is not restricted to, the illicit duplication or dissemination of motion pictures, audiovisual works, books, images, software, or any other intellectual property. Any attempt to sell counterfeit goods will result in the instant cancellation of your account. Any account that is discovered to be violating someone else’s intellectual property rights will be promptly deleted, and access to the content will be blocked. If an account is discovered to be repeatedly violating this restriction, it may be suspended or closed.

3. Inadmissible Content
Zero Tolerance Policy for Adult Content
Regarding pornographic material, FandomHost, LLC has a zero tolerance policy in place. Anything deemed “adult material” is not permitted on our systems. This covers any media that FandomHost, LLC, in its sole discretion deems to be of an adult nature, including media that may contain nudity or partial nudity. This policy will be promptly canceled without reimbursement to violators. Below is a list of other content that is prohibited:

Hacking, phishing, spamming, scamming, fraud, deceit, forgeries, network assaults, identity theft, and interfering with another user’s usage of the Services are examples of illegal activity.
The usage, gathering, monitoring, or accessing of data, systems, or networks without authorization.Communicating, disseminating, or retaining information that is unlawful, fraudulent, or that would violate someone else’s intellectual property, privacy, publicity, or other rights, such as a copyright, patent, trademark, trade secret, or other proprietary right.
Harassing others or sending objectionable material that is improper, obscene, libelous, abusive, threatening, or promotes violence, or that contravenes any law, rule, or public policy.Laws pertaining to data protection and privacy, as well as laws against unsolicited commercial electronic messages, must also be complied with by you and your Users in relation to your use of the Services.
4. Forbidding Child Pornography
Anything that FandomHost, LLC deems in its sole discretion to be detrimental to minors is absolutely prohibited. This includes, but is not restricted to, pornographic material for children or anything that is believed to be child pornography. Any website that is discovered to contain or link to child porn will be taken down instantly and without warning.
5. Resellers Are Not Allowed to Use Free Web Hosting
It is prohibited for FandomHost Resellers to provide their clients ‘free web hosting’ services.
6. Additional Restricted Information
Anybody may be denied service at our discretion. The content on our servers may be deleted (or otherwise disabled) with or without notice if we determine that it is offensive, dangerous, unlawful, or in any other way violates this AUP or our Terms of Service.
7. Inappropriate Use of Resources
Maybe not:
Utilize at least 25% of our system resources for periods exceeding ninety (90) seconds at a time. Use of FTP, PHP, HTTP, CGI scripts, and other programs are a few examples of activities that might result in this excessive use.
Whenever you choose, you may use the server to run unattended, stand-alone operations. This covers all daemons, including IRCD.
Run any kind of indexer or web crawler on shared servers, such as AdSpy or Google Cash.
Launch any program that communicates with an Internet Relay Chat (IRC) network.
Launch any bit torrent client, tracker, or program. Legal torrents may be linked to off-site, but you are not allowed to host or keep them on our shared servers.
Engage in any peer-to-peer or file-sharing activity.
Run any game servers, such those for Half-Life, Counter-Strike, and Warfare 1942, among others.
Use intervals of no more than fifteen (15) minutes while running cron entries.
Run any queries in MySQL that take more than fifteen (15) seconds. The MySQL tables need to be properly indexed.
When using PHP, use the local file instead of the URL; include functions for local file inclusion. Use “include.php” in place of “http://yourdomain.com/include.php”.
In order to aid minimize utilization, force HTML to handle server-side code (such as PHP and SHTML).
8. INTERODES
If you use more than 250,000 inodes on a shared or reseller account, you can receive a warning and your account might be suspended if you don’t take measures to cut down on the excessive inode consumption. To prevent overuse, accounts exceeding one hundred thousand (100,000) inodes will be immediately deleted from our backup system; databases will still be backed up on a courtesy basis at our sole discretion. Each file on your account, such as a website, picture file, email, etc., consumes one (1) inode.
A user account may be marked for review and/or suspension if it regularly creates and deletes significant amounts of files, has hundreds of thousands of files, or damages the file system. Usually, users who leave their catchall address activated but never check the mailbox associated with their primary account are the main cause of excessive inodes. Tens of thousands of messages, or perhaps more, accumulate over time, eventually pushing the account beyond a reasonable number of inodes. Go into cPanel, choose “Mail,” “Default Address,” “Set Default Address,” and then enter “:fail: No such user here” to deactivate your default mailbox.
9. The policy against accepting spam
Bulk emailing, spamming, and unsolicited emailing are all prohibited by us. The following will be regarded as spam: “safe lists,” lists that have been acquired, and lists sold. If a user sends out spam, we have the right to suspend or delete their account.
We may decide not to host websites that are marketed using spam (also known as spamvertised). This clause covers spam transmitted by phone, fax, mail, email, instant messaging, usenet/newsgroups, and postal mail, among other channels. We reserve the right to host no entity or organization identified in the ROKSO on our systems. We shall promptly suspend and/or cancel any User account that causes our IP space to be banned.
Any website, account, database, or other component that violates our policies may be required to alter or disabled at FandomHost, LLC’s sole discretion. In the event of an emergency, we may also make these adjustments.
At our sole discretion, FandomHost, LLC retains the right to impose cleanup fees or penalties for blacklist removal on the owner of the account used to send any unsolicited email.
10. Policy for WHMCS Support
Please be aware that aside from the original installation, our support personnel have not received any more training on the WHMCS program. Please contact the WHMCS Reseller Support staff directly at the following links with any troubleshooting questions.

11. The Policy on Defamation
U.S. law governs websites hosted on FandomHost, LLC’s servers in the United States. As a result, FandomHost, LLC’s policy is not to delete allegedly defamatory content from websites hosted on our servers in accordance with Section 230(c) of the Communications Decency Act unless the content has been determined to be defamatory by a court and is supported by a court order. FandomHost, LLC is a site host; we are not a publisher of user material, and we are not able to look into the accuracy of specific defamation accusations. To decide whether or not anything is truly defamatory, we rely on the legal system and the courts. We will block access to any content that is found to be slanderous, libelous, or defamatory by a court order. Likewise, we shall cooperate and remove or block access to any material that is the subject of an injunction issued by a U.S. court prohibiting it from being made public.
12. Identify the Rights of FandomHost LLC
Investigating real, suspected, or claimed violations of this AUP is always within FandomHost, LLC’s rights. If you or any User has actually or allegedly violated this AUP, you will obediently assist FandomHost, LLC in their investigation and remediation. In addition, FandomHost, LLC maintains the right to collaborate with law enforcement and outside parties in the investigation of any purported AUP breaches, including revealing the identity of any User that FandomHost, LLC suspects of being in violation. Technical measures to stop AUP breaches may be put in place by FandomHost, LLC.
There are no rights or remedies at law or in equity that FandomHost LLC may have that are limited by this AUP.
13. Retraction
FandomHost, LLC does not assume any liability for any misuse of the Services by Users and is not obligated to monitor User actions. When it comes to content published, stored, maintained, communicated, or accessible on or via the Services by Users or other third parties, FandomHost, LLC disclaims all liability and is not required to monitor or exert editorial control over such content. If FandomHost, LLC finds out about any content that violates this AUP and/or puts FandomHost, LLC in danger of legal action, it is not obligated to remove the content; but, FandomHost, LLC may choose to do so. In the absence of a written agreement between the user and FandomHost, LLC for the use of the Services, FandomHost, LLC disclaims all liability to the user.
14. Infractions of the AUP
Any breach of this AUP may result in the termination of your services, with or without prior notice. Violations will be reported, if applicable, to the relevant law enforcement body.
Should you neglect to reply to an email from our abuse department within 48 hours, or as directed by the email, your services might be suspended or terminated. You must submit trouble tickets or emails for any abuse concerns, and you will hear back from us within 48 hours.
